The European Committee of the Council of Ministers (KERM)
The European Committee of the Council of Ministers (Komitet Europejski Rady Ministrów, KERM) established in 2004 was one of the three standing committees of the Council of Ministers. It was a forum where standpoints were agreed upon, current decisions were made and European policy issues were discussed. The European Committee acted as a competent decision-making body where decisions and issues resulting from the Polish integration policy were agreed upon, made and settled. The European Committee resolved also possible disputes between ministries, which arose in the course of working out the standpoints presented by the representatives of the Polish Government in the works of EU institutions. The works of the KERM were supported by the Office of the Committee for European Integration.
For the purpose of coordinating the works correctly and ensuring a possibility to efficiently fulfil its tasks, the KERM was authorized to make decisions concerning the modelling of European policy, wherever such competences were not reserved solely for the Council of Ministers.
The KERM considered in particular:
- information from the Council of Ministers on the participation of the Republic of Poland in the works of the European Union;
- schedules of legislative works related to the implementation of the EU law into the Polish law and information concerning the progress in following such schedules;
- draft acts implementing the EU law into the Polish law;
- information from the Council of Ministers concerning the progress in procedures of adopting legal acts of the European Unions and drafts of standpoints assumed by the representatives of the Council of Ministers in the course of such procedures;
- draft resolutions concerning allocation of funds from the European Union and from foreign aid;
- standpoints for meetings of the Council of the European Union and the Permanent Representatives Committee;
- standpoints concerning reforms of the European Union;
- standpoints concerning draft legal acts of the European Union;
- standpoints concerning EU documents subject to consultations with the Member States and assessments thereof formulated by competent institutions or other bodies of the European Union;
- standpoints concerning agendas of the Council of the European Union, annual legislative plans of the European Commission and assessments of the annual legislative plans prepared by the European Parliament and the Council of the European Union;
- standpoints concerning draft international agreements, the parties to which shall be the European Union, the European Communities or the Member States thereof;
- standpoints concerning draft acts of the European Union without legal force, in particular proposed guidelines to be adopted in the area of economic and monetary union and the area of employment;
- decisions concerning matters related to proceedings before the European Court of Justice;
- documents concerning preparation of the staff of ministries and central offices;
- programmes of informing the society on the consequences of Poland's accession to the European Union and reports on the implementation of such programmes;
- information concerning progress in works related to the translation of Community law.
Composition of the European Committee of the Council of Ministers:
ECCM was chaired by the Chairperson of the Committee for European Integration. Amongst the members of the European Committee of the Council of Ministers there were also secretaries or undersecretaries of state in the ministries whose area of activity covered European integration issues.
Committee meetings were held twice a week - on Tuesdays and Fridays, which resulted from the schedule of works of the community bodies.
